NOT THE SHARPEST KNIFE IN THE DRAWER: Free Speech For Fido?
Fred Kilkenny, who had gone to MS helping Hurricane Katrina victims, got a ticket because his dogs back in Belfield, ND, would not stop barking. He sued on the grounds that the town’s anti-barking law is too vague to be fairly enforced, and is therefore unconstitutional. Somehow, the case made it all the way to the North Dakota Supreme Court, which rejected Kilkenny’s claim that under the U.S. Constitution, barking is “speech.” Kilkenny may appeal the ruling to the U.S. Supreme Court. The Stiletto is betting this dog of a case does not make it onto the docket, Kilkenny’s pit-bull tenacity notwithstanding.
