WHAT A HEEL!: Judge Jails 14 Over Ringing Cell Phone
The NY Commission on Judicial Conduct recommended that Niagara Falls City Court Judge Robert M. Restaino be removed from the bench because he had 46 domestic violence defendants locked up as each denied a ringing cell phone belonged to him. Thirty-two made the $1500 bail and were released; 14 were bused to a lockup half an hour away. “The judge ultimately ordered their release by the end of the day, though some were in custody for six hours or more, according to the commission. None were given transportation back to Niagara Falls,” reports New York Law Journal. The commission held that Restaino had "abandoned his role as a reasonable, fair jurist and instead became a petty tyrant, abusing his judicial power and placing himself above the law."
