NOT THE SHARPEST KNIFE IN THE DRAWER: Who Says The Wheels Of Justice Are Slow?

 

District Court Judge Norman St. George granted a man named Maharaj an adjournment in contemplation of dismissal (ACD) of a marijuana possession charge, provided he kept his nose clean for six months. The judge also yanked Maharaj’s driving privileges on an unrelated drunken-driving charge and ordered him to surrender his conditional license. As Maharaj was handing the license to the court clerk, several people in the Nassau County, N.Y., courtroom saw marijuana in the creases of the license. He was arrested on the spot and charged with a new count of violating Penal Law §221.05, Criminal Possession of Marijuana. Maharaj argued that the new possession charge occurred before the ACD period started, but the judge ruled that the adjournment had been granted before he turned in his license so his arrest "instantly violated" the terms, reports New York Law Journal.
