NOT THE SHARPEST KNIFE IN THE DRAWER: Branch Manager’s Boss Had 570,000 Other Reasons To Fire Him
Harleysville National Bank branch manager Robert Edwards, sued his employer for violating the Family and Medical Leave Act because he was fired a month after telling bank executives that he planned to take off for knee-replacement surgeries, reports The Legal Intelligencer. But he wasn’t fired for asking to take a leave of absence. Rather, for failing to enforce internal control procedures, enabling the head teller to carry out a six-year $570,000 embezzlement scheme. District Judge Lawrence F. Stengel dismissed the claim on the grounds that “the FMLA does not provide employees with a right against termination for a reason other than interference with rights under the FMLA.” In other words, coincidentally asking for a leave of absence does not make you bulletproof if you screw up and your employer cans you.
