NOT THE SHARPEST KNIFE IN THE DRAWER: Despite A Bang-Up Defense, Attorney’s Client Still Convicted

KS attorney Sam Kepfield allegedly used a “dud” grenade as a prop during his closing arguments to make the point that his client was compelled to forge stolen checks after being threatened with bodily harm, reports The Hutchinson News:

 

Kepfield pulled out the grenade, set it on a ledge in front of the jury box, then set it on a table in front of Assistant District Attorney Amanda Voth.

"I was trying to demonstrate what's called an imminent threat," Kepfield said Tuesday.

He pulled the pin from the grenade and asked jurors, "Are you afraid now?", according to Voth, who said she was surprised and didn't object. …

Jurors took about 15 minutes late Monday to find Daily guilty of forgery, conspiracy to commit forgery and misdemeanor theft, Voth said.

 

Meanwhile, Sheriff's Capt. Wayne Baughman is taking a dim view of the stunt, noting that it's illegal for people to bring fake or real weapons into the courthouse, and is looking into whether Kepfield can be charged with criminal use of explosives.
