WHAT A HEEL: Attorney Claims Airbag Caused Amnesia

On March 23, 2008, WI attorney Eric Forstrom collided with another car then walked away from the scene of the accident. The next day, he reported his car stolen and initiated a claim with his insurance company. When a police investigation determined he owned the car involved in the hit-and-run accident, Forstrom wrote to the insurance company to withdraw the claim. Yada, yada, yada, and a year later he entered an "initial guilty plea" to insurance fraud. The charge was later reduced to a misdemeanor and ultimately dismissed. Forstrom has an explanation for how his actions could have been misinterpreted as insurance fraud, reports LegalBlogWatch:

 

[H]e "suffered a concussion/brain trauma caused by airbag deployment" that caused him to temporarily have no recollection of the accident. Thus, he "did not recall being involved in an auto accident at the time he initiated the insurance claim that led to his conviction." In the weeks following the accident, however, Forstrom's memory resurfaced, leading him to formally withdraw his insurance claim.

 

Forstrom, who is admitted to practice in CA and WI, has had his law license suspended for a year in both states.
